Homeland Security: Tearing Nursing Babies From Their Mothers' Arms

Yesterday Homeland Security arrested allegedly illegal immigrant workers (mostly women) in New Bedford, Mass. and, presuming them guilty, shipped dozens of them to Texas, without any apparent thought to what would happen to their children. Two nursing babies were hospitalized for dehydration. Babies! What is wrong with these zealots?

[Massachusetts Governor] Patrick, at a press conference, and later in a private conference call with Homeland Security officials, protested the decision to fly 90 of the detained workers from Massachusetts to Harlingen, Texas, before state social workers had a chance to inquire about their child-care needs, potentially leaving many children with inadequate care. Two young children were hospitalized yesterday for dehydration after their nursing mothers were taken away, state officials said. Another 7-year-old girl called a state hot line seeking her detained mother. It was unclear last night where their mothers were.

Of course, the Immigration and Customs Enforcement Division of DHS, which carried out the raids, is led by the unqualified, crony appointee, Julie Myers, who is both daughter of former chairman of the Joint Chiefs of Staff, Gen. Richard B. Myers, and wife of the chief of staff for Homeland Security's criminally incompetent Michael Chertoff. Nice work, Heckuva-Jobbers.

What do you think happened to the owners, who were breaking the law by employing illegal immigrants, creating fraudulent documents for those workers, making profits, and defrauding the federal government which had contracted with them to make vests for soldiers? You got it if you guessed they were charged, made bail, and released to spend the night at home in the comfy houses with their families.

"HAS ANYONE seen my wife? She left for work yesterday and never came home. Our newborn baby is hungry and crying. Can someone please help?" asks a young father in the basement of a crowded church, one clear voice above the din of the hundreds gathered. The fear is palpable in the young man's eyes. He implores the listener to offer solace, hope, and encouragement.

On Tuesday, more than 500 armed homeland security officers descended upon Michael Blanco Inc. The owner of the factory, and a few of his senior staff, were arrested for hiring undocumented workers and creating false documents. They were out on bail and home with their families that night.

Approximately 350 employees, mostly mothers with young children, were swept up in the raid, shackled together in groups of three by their wrists and ankles and marched to buses bound for Fort Devens, 100 miles away. Without any legal representation or due process, these workers were asked for their immigration documentation and encouraged by immigration officers to choose voluntary deportation regardless of whether an immigration application was in process.

I think Paul Krugman should have titled his column today "The Incompetence, the Corruption, and the Cronyism", but he called it The Crony Fairy (behind the TimesSelect wall; Middle Earth Journal has the column here.)

On the other hand, the history of the Bush administration, from the botched reconstruction of Iraq to the botched start-up of the prescription drug program, shows that a president who isn't serious about governing, who prizes loyalty and personal connections over competence, can quickly reduce the government of the world's most powerful nation to third-world levels of ineffectiveness.

And bear in mind that Mr. Bush's pattern of cronyism didn't change after Katrina. For example, he appointed Julie Myers, the inexperienced niece of Gen. Richard Myers, to head Immigration and Customs Enforcement — an agency that, like FEMA, is supposed to protect us against terrorism as well as other threats. Even at the C.I.A., the administration seems more interested in purging Democrats than in improving the quality of intelligence.

So let's skip the name change for FEMA, O.K.? The United States will regain effective government if and when it gets a president who cares more about serving the nation than about rewarding his friends and scoring political points. That's at least a thousand days away. Meanwhile, don't count on FEMA, or on any other government agency, to do its job.

The Corruption: Lie about your political aims (Compassionate Conservatism, Against Nation Building); cheat to get into office (Florida 2000; Ohio 2004)

The Cronyism: Reward friends and bagmen (Pioneers) with appointments (Michael Brown, Harriet Miers, Tom Ridge) to jobs they can screw up.

The Incompetence: Run federal agencies into the ground (FEMA, Army Corps of Engineers, EPA, OSHA).

Declare war and go home to reap the profits (probably to be employed in Iraq very soon.): Proclaim that government doesn't work, get lame members of Congress to support abolishing government agencies.

The new Medicare drug plan is an unmitigated disaster. It's impossible to figure out. Seniors can't figure it out. Pharmacies can't figure it out either. As a result, they're refusing to give people their medications. People will die because of this simple fact: The Bush Administration is incompetent. They care more about ideology than good government, and as we saw during Hurricane Katrina, that's often fatal.

States Intervene After Drug Plan Hits Early Snags

WASHINGTON, Jan. 7 - Low-income Medicare beneficiaries around the country were often overcharged, and some were turned away from pharmacies without getting their medications, in the first week of Medicare's new drug benefit. The problems have prompted emergency action by some states to protect their citizens.

Although there are no hard numbers, concerns expressed by state officials and complaints from pharmacists suggest a widespread pattern of problems.

At least four states - Maine, New Hampshire, North Dakota and Vermont - acted this week to make sure poor people received the drugs they were promised but could not obtain through the federal Medicare program.

Gov. Jim Douglas of Vermont, a Republican, said the state would pay drug claims for low-income people until the federal government fixed problems in the new program, known as Part D of Medicare. Michael K. Smith, the state's secretary of human services, said, "The federal system simply is not working."

On Thursday, the Vermont Legislature passed a bill declaring, "There is a public health emergency due to the federal implementation of Medicare Part D, which has resulted in serious operational problems, causing Vermonters to be turned away at the pharmacy without the drugs they need."

DeLay and two others helped put the brakes on a federal probe of a businessman. Evidence was published in the Congressional Record.

WASHINGTON — In a case that echoes the Jack Abramoff influence-peddling scandal, two Northern California Republican congressmen used their official positions to try to stop a federal investigation of a wealthy Texas businessman who provided them with political contributions.

Reps. John T. Doolittle and Richard W. Pombo joined forces with former House Majority Leader Tom DeLay of Texas to oppose an investigation by federal banking regulators into the affairs of Houston millionaire Charles Hurwitz, documents recently obtained by The Times show. The Federal Deposit Insurance Corp. was seeking $300 million from Hurwitz for his role in the collapse of a Texas savings and loan that cost taxpayers $1.6 billion.

The investigation was ultimately dropped.

The Cronyism:

George Bush appoints unqualified Julie Myers to head the bureau of Immigration and Customs Enforcement.

Here's the story, under a bad headline by the Times (surprised?) as criticism of this 36-year-old lawyer with no immigration and scant managerial experience is broad and bipartisan.

Ms. Myers, who has held a variety of federal jobs over the last four years, drew attention because of her ties to the White House and some senior officials. She is a niece of Gen. Richard B. Myers, who recently stepped down as chairman of the Joint Chiefs of Staff, and the wife of John Wood, Mr. Chertoff's chief of staff.

Criticism of her nomination was not limited to the comments of Democrats. In September, National Review, an influential conservative publication, urged Mr. Bush to withdraw Ms. Myers's nomination. In an editorial, the magazine compared her to Mr. Brown and called her "another unqualified nominee for a vital position in the Department of Homeland Security."

Couldn't find anything of note on Nadine Hogan. Most of the linked material is from sourcewatch.org. These were appointments that are on hold for specific reasons. Lawyers who advocated for torture; AMTRAK board members who've never ridden a train; just your typical Bushco appointees meant to kill the governmental entity to which they are being appointed.

And hey, who needs the Senate and all that pesky Advise and Consent stuff when you've already declared "ah'm a wahr prezident"?

Amongst them -- Hans von Spakovsky, who was in large part responsible for the purge of mostly Democratic, mostly African American and mostly legitimate people from the Florida voting lists in 2000.

Earlier this year, President Bush appointed 66-year-old Sam Bodman to serve as Secretary of Energy, a guy who for more than a decade ran a Texas-based chemical company that spent years on the top-five lists of the country's worst polluters.

And what action will our incompetent Republican Party take to protect the environment? Have the eternally dumb Imhofe (dumber than a bag of hammers and half as useful) have hearings featuring witness Michael Crichton, writer of fiction, testify about it (yes, truth IS stranger than fiction).

WASHINGTON, Sept. 28 - His last book, "State of Fear," was published more than nine months ago, but the reviews were still pouring in on Wednesday, even as Michael Crichton folded his 6-foot-9-inch frame into a seat to testify before the Senate Committee on Environment and Public Works.

"More silly than scary," the flier dropped off by the Natural Resources Defense Council said.

"Notable mainly for its nuttiness," an analysis from the Brookings Institution said.

"Does not reflect scientific fact," the Union of Concerned Scientists said.

His is an unpopular and contrary stance when measured against the judgment of groups like the National Academy of Sciences. But it was not those organizations that asked Mr. Crichton to Washington to counsel Congress on how to consider diverse scientific opinion when making policy. It was the committee chairman, Senator James M. Inhofe, a plainspoken* Oklahoma Republican who has unabashedly pronounced global warming "the greatest hoax ever perpetrated on the American people."

In Mr. Crichton, a Harvard medical school graduate who never practiced medicine, he had found a kindred spirit - and a star witness for his committee.

* "Plainspoken" is apparently NYTimesSpeak for "stupid".


The Corruption:

Tom Delay get indicted again, by a different grand jury, for the same conduct, but this time there are two indictments. The man is just a walking ham sandwich. Oh, and this time, if convicted, he could get a life term. And in Texas, life means life.

What Julie Myers is to the Department of Homeland Security, Harriet Miers is to the Supreme Court. It's not just that Miers has zero judicial experience. It's that she's so transparently a crony/"diversity" pick while so many other vastly more qualified and impressive candidates went to waste. If this is President Bush's bright idea to buck up his sagging popularity--among conservatives as well as the nation at large--one wonders whom he would have picked in rosier times. Shudder. Just talked to a very pro-Bush legal type who says he is ashamed and embarrassed this morning. Says Miers was with an undistinguished law firm; never practiced constitutional law; never argued any big cases; never was on law review; has never written on any of the important legal issues. Says she's not even second rate, but is third rate. Dozens and dozens of women would have been better qualified. Says a crony at FEMA is one thing, but on the high court is something else entirely. Her long history of activity with ABA is not encouraging from a conservative perspective--few conservatives would spend their time that way. In short, he says the pick is “deplorable.” There may be an element of venting here, but thought I'd pass along for what it's worth. And, really, she's just your average, run-of-the-mill, crooked corporate lawyer:

Miers Led Law Firm Repeatedly Forced to Pay Damages For Defrauding Investors

In case anyone thought Harriet Miers wasn't a corporate-shill-in-White-House-clothing, take a gander at how Miers did her best Ken Lay impression while heading a major Texas corporate law firm. That's right, according to the 5/1/00 newsletter Class Action Reporter, Miers headed Locke, Liddell & Sapp at the time the firm was forced to pay $22 million to settle a suit asserting that "it aided a client in defrauding investors."

The details of the case are both nauseating and highly troubling, considering President Bush is considering putting Miers at the top of America's legal system. Under Miers' leadership, the firm represented the head of a "foreign currency trading company [that] was allegedly a Ponzi scheme." The law-firm admitted that it "knew in March 1998 that $ 8 million in [the company's] losses hadn't been reported to investors" but didn't tell regulators.

This wasn't an isolated incident, either. The Austin American-Statesman reported in 2001 that Miers' lawfirm was forced to pay another $8 million for a similar scheme to defraud investors. The suit, which dealt with actions the firm took under Miers in the late 1990s, was again quite troubling. As the 9/20/00 Texas Lawyer reported, Miers' firm helped a now-convicted con man "defraud investors and allowed the firm's [bank] account to be used as a 'conduit.'" The suit said "money from investors that went into the firm's trust account was deposited into [the con man's] bank accounts and was used to pay for his 'expensive toys.'"

If you think Miers wasn't involved in any of this -- think again. Miers wasn't just any old lawyer at the firm. She was the Managing Partner -- the big cheese.

The Incompetence:

FDA head steps down abruptly

Washington -- Lester Crawford, the commissioner of the Food and Drug Administration, resigned abruptly Friday, causing further upheaval at an agency that has been in turmoil for over a year.

Crawford, who was confirmed just two months ago, on July 18, did not say why he was stepping down....

On Thursday, a commentary in the New England Journal of Medicine titled "A Sad Day for Science at the FDA" said that "recent actions of the FDA leadership have made a mockery of the process of evaluating scientific evidence," disillusioned many scientists, "squandered the public trust and tarnished the agency's image."...

Sen. Barbara Mikulski, D-Md., said the agency had been "politicized and degraded" under Crawford, whose leadership she described as "tepid and passive."

At the FDA, as at the Federal Emergency Management Agency, Mikulski said, the Bush administration had brought "incompetent leaders into critical positions."

The Corruption:

Frist Knew About Blind Trust Investments

WASHINGTON - Senate Majority Leader Bill Frist, R-Tenn., was updated several times about his investments in blind trusts during 2002, the last time two weeks before he publicly denied any knowledge of what was in the accounts, documents show.

The updates included stock transactions involving HCA Inc., the hospital operating company founded by Frist's family.

Frist's sale of HCA stock is under scrutiny by the federal government. Nashville, Tenn.-based HCA said Friday it had received a subpoena from prosecutors for the Southern District of New York, asking for documents the company believes are related to Frist's sale of company stock this past summer.

The Cronyism:

Amid Many Fights Over Qualifications, a Bush Nomination Stalls in the Senate

WASHINGTON, Sept. 23 - Faced with accusations that the Bush administration is stocking the government with unqualified cronies, the Republican chairwoman of the Senate Homeland Security and Governmental Affairs Committee is holding up the nomination of a lawyer [Julie L. Myers] with little background in immigration or customs to head the law enforcement agency in charge of those issues.

In addition to the questions about Ms. Myers, Senator Carl Levin of Michigan has objected to the nomination of Stewart Baker to be assistant secretary of homeland security for policy. Mr. Baker, who won committee approval despite Mr. Levin's opposition, is an accomplished technology lawyer, but he has little experience in disaster management.

At the same time, the Center for American Progress, a research institute for out-of-office Democratic policy experts, has questioned whether Andrew B. Maner is qualified for his position as chief financial officer of the Homeland Security Department, which has a budget of about $35 billion and more than 180,000 employees. Mr. Maner's main government experience before joining this administration was a job in the White House press office under the first President Bush.

The questions of credentials are not limited to homeland security. For example, the main experience of Brian D. Montgomery, who in June became assistant secretary for housing and federal housing commissioner, was performing advance work in the Bush presidential campaign of 2000 and in the current administration's first term.

Mr. Montgomery's responsibilities now include overseeing the $500 billion Federal Housing Administration insurance portfolio. His background in housing is limited to a few years as communications director of the Texas Department of Housing and Community Affairs.
